The website and the brand The cheeky monkey are managed by Marketing in prodaja, Anja Saje s.p., provider of e-business services (hereinafter referred to as the Provider). Also, the terms "we", "us" and "our" throughout the website refer to the Provider. By using the information, e-tools and other services available on this website, the visitor becomes a user who accepts all terms of business and all data stated in the Terms and Conditions (hereinafter referred to as terms) and enters into a contractual relationship with our company.

By visiting the website www.thecheekymonkey.eu and by purchasing products, you agree to all terms, including those on external links. The terms apply to all users of the website regardless of their status (user, buyer, casual visitor, etc.). Before using the website www.thecheekymonkey.eu, please read our terms carefully, as by accessing / using any part of our website, you agree to them.

The Cheeky Monkey is not the manufacturer of the products. The use of the products is at your own risk. Before use, check whether the product meets your safety expectations. The products are manufactured in China and are imported through an independent distributor. 

We reserve the right to update, change or replace any part of these terms. It is the user's responsibility to check whether the terms have been changed, as by continuing to use or access our website, they agree to the changes.

The Cheeky Monkey website is hosted by the web service provider Shopify Inc., which provides the electronic platform for our e-business and enables the sale of our products and services.

Online store terms
The general terms and conditions of the online store www.thecheekymonkey.eu are compiled in accordance with the Consumer Protection Act (ZVPot), based on the recommendations of the Chamber of Commerce and Industry of Slovenia and international codes for online and electronic commerce. They cover the operation of the online store, the rights of the buyer and the business relationship between the buyer and the seller or the operator of the online store. By purchasing, the visitor confirms and guarantees that they are an adult and legally capable person. 

Availability of information
The Provider undertakes to provide the buyer with the following information:

- company identity (company name and registered office, registration number)
- contact details that enable quick and effective communication
- essential characteristics of goods or services 
- availability of products within a reasonable time
- terms of delivery of the product or performance of the service (method, place and time of delivery)
- unambiguous and clearly marked prices, tax amount and shipping costs
- method of payment and delivery
- validity of the offer
- period within which it is still possible to withdraw from the contract and conditions 
- explained complaint procedure 

Product offer, delivery time and collection
The offer of products in the online store changes and is updated frequently and quickly due to the nature of online business. The delivery time for products that are in stock is a few working days for delivery addresses in Slovenia, unless the delivery service delivers to the individual delivery address later. For other products, the delivery time stated next to the product in the online store applies to delivery addresses in Slovenia. Every product from the online store is available within a reasonable time.

Payment methods
The Provider allows the user to pay for products purchased from the online store by advance transfer of the purchase price to the Provider's transaction account according to the proforma invoice, via the online application Paypal or by payment card or cash on delivery.

Prices
The online price applies to all registered users of the website. The online price may be subject to surcharges, depending on the selected payment method. All prices in the online store are stated in euros and include VAT, unless expressly stated otherwise. All prices in the online store are product prices and do not include shipping costs. All prices are valid only for electronic ordering of products through the online store.
All prices are valid at the time of placing the order and do not have a predetermined validity, so they are valid only until they are changed. Despite extreme efforts by the Provider to ensure the most up-to-date and accurate data, it may happen that the price information is incorrect. In the event of the previous sentence and in the event that the price of the product changes during the order processing, i.e. from the moment of placing the order to the confirmation of the order, the Provider will:
- inform the user (buyer) and notify them of the new prices, in such a case the user (buyer) has the option to change their order or partially or completely cancel it or confirm the order at the new prices, all without additional costs; or
- allow the user (buyer) to withdraw from the purchase and at the same time offer a solution that will be mutually beneficial and satisfactory.

Purchase process

The following steps are available to the user (buyer) during the purchase process:
- logging into the online store using an email address or user password, if the user (buyer) has already created a user account (see also point 1.);
- searching for an individual product in the product offer in the online store;
- selecting a product for purchase;
- adding the selected product for purchase to the shopping cart;
- determining the quantity of the product for purchase in the shopping cart;
- reviewing the price of the selected product in the selected quantity, including the calculated tax, if applicable;
- selecting the product delivery method;
- selecting the payment method;
- reviewing the order with the selected product delivery method and calculated shipping costs, if applicable, and
- confirming and placing the order, thereby completing the purchase.

Identifying and correcting errors before placing an order
Before placing an order, the user (buyer) is enabled, through the graphical user interface, to immediately, easily and without difficulty:
- see and check which products they have selected and added to the shopping cart;
- see and check the price of each individual product and the total price of the entire selected quantity of each individual product;
- change the selected quantity of an individual product and calculate the new price of the changed quantity;
- remove selected products that they do not wish to purchase from the shopping cart, and
- calculate the applicable tax, according to the tax rate applicable to the selected product and its price (tax base).

Before confirming the order, the user (buyer) is enabled, through the user interface, to immediately, easily and without difficulty:
- change the selected product delivery method;
- change the selected payment method, and
- review and confirm individual changes.

Order acceptance
After placing the order, the user (buyer) receives a notification of order acceptance from the Provider by email. Within one hour of receiving this notification, the user (buyer) has the option to cancel the order without consequences. Except for the option to cancel, the user (buyer) cannot change the content of the order after placing it. The user (buyer) always has access to comprehensive data on the status and content of each order in their profile on the Provider's website.

Order confirmation

If the user (buyer) does not cancel the order, the order goes into further processing. Upon receipt, the Provider reviews the order, checks the availability of the ordered products and confirms or rejects the order with a reason. The Provider may also contact the user (buyer) by phone at the provided contact phone number to verify data or ensure delivery accuracy. Upon confirmation of the order, the Provider informs the user (buyer) by email of the estimated delivery time. The sales contract for the purchase of ordered products between the user (buyer) and the Provider is irrevocably concluded at this stage.

Order shipped

Within the agreed timeframe, the merchant prepares and ships the ordered products and informs the user (buyer) about this by email. In the email from the previous sentence, the Provider also informs the user (buyer) about the product return policy and introduces them to the contact persons in case of a complaint or delay in delivery.

Sales contract
The Provider issues a written invoice to the user who purchases a product from the online store, with itemized costs and an explanation of the right to withdraw from the purchase by returning the purchased product, if necessary and possible. The sales contract in the form of a purchase order is stored electronically on the Provider's server and is accessible to the user (buyer) at any time in their user profile. The sales contract is concluded in Slovenian.
The sales contract between the Provider and the user (buyer) is concluded at the moment the Merchant confirms the order. From this moment on, all prices and other purchase conditions are fixed and apply to both the Provider and the user (buyer).

Right to withdraw from purchase, product returns
The user (buyer) has the right to notify the Provider at the email address hello@thecheekymonkey.eu within 7 days from the date of receipt of the ordered products that they are withdrawing from the sales contract, without having to state a reason for such a decision. The return of purchased products to the Provider within the period for withdrawal from the sales contract counts as a notice of withdrawal. The only cost charged to the user (buyer) due to withdrawal from the sales contract is the cost of returning the products to the Provider.
Purchased products must be returned to the Merchant no later than 14 days from the date of notification of withdrawal from the sales contract. Purchased products must be returned to the Merchant undamaged, in their original packaging and in unchanged quantity, unless the products are destroyed, spoiled, lost or their quantity has decreased without the fault of the user (buyer). If the postal package with which the user (buyer) received the ordered products is physically damaged, if its contents are missing or if it shows signs of opening, the user (buyer) must initiate a complaint procedure with the delivery service before acceptance.
For returned products, the Provider will refund the paid amount or redeemed gift voucher to the user (buyer) as soon as possible, but no later than 14 days from the receipt of the withdrawal notification; any redeemed promotional codes and other discounts will not be refunded to the user (buyer). The Provider will refund the paid amount to the user's (buyer's) personal or transaction account. The Merchant will return the redeemed gift voucher in the form of a credit note.

Shipping
The Provider will deliver the ordered products to the user (buyer) within the agreed timeframe with the delivery service that will fulfill the order most efficiently.

Security
The Provider uses appropriate technological and organizational means to protect the transmission and storage of personal data and payments. The user is also responsible for their own security, by taking care of the security of their username and password and for appropriate software and antivirus protection of their computer.

Privacy Policy
The Privacy Policy is also part of these General Terms and Conditions.

Responsibility
The Provider makes every effort to ensure the timeliness and correctness of the published data, but the characteristics of the products, delivery time or price can change so quickly that the Provider cannot correct the data published in the online store in time. In such a case, the Provider will inform the user (buyer) about the changes and allow them to cancel or change the order.
Although the Provider strives to provide accurate photographs of the products for sale in the online store, all photographs should be taken as symbolic. Photographs do not guarantee product characteristics.
From the moment the shipment with the ordered products is sent to the post office, the Provider is not responsible for cases of physical damage, destruction or loss of the shipment, nor if there is a lack of content in the shipment or if the shipment shows signs of opening. In the aforementioned cases, the user (buyer) must initiate a complaint procedure with the delivery service before receiving the order. In case of damage to the shipment, this is done by delivering the shipment to the delivery service in the same condition as it was received, without adding or removing anything, and by filling out a complaint record.

Complaints, disputes and application of law
The Provider respects the applicable regulations in the field of consumer protection, so it has an established effective system for handling complaints and a designated person with whom the user (buyer) can contact by email in case of problems. The user (buyer) can submit a complaint to the email address hello@thecheekymonkey.si. The complaint handling procedure is confidential.
The Provider will confirm receipt of the complaint within five working days and inform the user (buyer) how long it will take to process it, and keep them informed of the progress of the procedure. The Provider will make every effort to resolve any disputes amicably. If an amicable settlement of the dispute is not reached, the court in Ljubljana has jurisdiction to resolve all disputes between the Provider and the user (buyer).
For these Terms of Business and for all disputes between the Provider and the user (buyer), Slovenian substantive and procedural law applies, whereby the rules of international private law that would refer to the application of any other law are not used.
For all relationships and for rights and obligations not regulated by these General Terms and Conditions, the provisions of the Obligations Code, the Electronic Commerce on the Market Act, the Personal Data Protection Act and the Consumer Protection Act shall apply mutatis mutandis.

Changes and additions to the Terms and Conditions
In the event of changes to regulations governing the operation of online stores, data protection and other areas related to the Provider's operations, and in the event of changes to its own business policy, the Provider may change and/or supplement these Terms of Business, about which it will always inform users in an appropriate manner, which includes in particular notification via the website www.thecheekymonkey.eu. Any changes and/or additions to the Terms of Business shall enter into force and apply after the expiry of an eight-day period from the publication of the changes and/or additions. If a change and/or addition to the Terms of Business is necessary due to compliance with regulations, these changes and/or additions may exceptionally enter into force and apply within a shorter period.



We reserve the right to refuse our services without explanation, to anyone. If you believe that the refusal in your case is not justified, please contact us at hello@thecheekymonkey.si. It is forbidden to use our products and content in any illegal and unauthorized way and thereby violate the law. Visitors and users undertake not to distribute copyrighted products and content owned by the provider, not to attempt to obtain, collect or store personal data of other users, and not to use computer codes, malicious programs or anything that could cause harm to the provider.

Any copying, transcription, reproduction and any dissemination of our material for commercial purposes (for non-domestic use) is prohibited without the written permission of the Provider.
